Pontianak (Antaranews Kalbar) - KRI (Warship of Republic Indonesia) Sembilang and 850 Satrol Lantamal XII  Pontianak (Pontianak’s unit of naval base patrol boats), foil the smugling of around a hundred tons of rattan to Malaysia.
  
"KLM Putri Setia was secured when KRI Sembilang-850 doing Poros Sagara Operation in April, 7 2018 around the waters of Pulau Datu (Sambas Regency)," said Commander of naval base (Danlantamal) XII Pontianak, the TNI’s first admiral, on Monday.
   
He explained, during the patrol operation KRI Sembilang suspected KLM Putri Setia,  so they investigate the ship then find out around 100 tons of rattan in type of sega which under the provision prohibit for exports.
   
" According to SPB ( Approval Sailing Letter), KLM Putri Setia should have sail to Jambi, but at the arrested time the ship was strayed far to north towards Malaysian waters," he said.
   
From the further examination result of KLM Putri Setia, allegedly occured criminal offenses which include customs crimes (illegal exports).
   
"Captain of KLM Putri Setia Rm acknowledged that the ship’s plan to Jambi is only fictitious for getting SPB from Syahbandar. Whereas KLM’s real destination is to Sibu, Malaysia, to smuggle the rattan," he said.
   
The captain of KLM Putri Setia and the rattan’s owner violates UU No. 17/2006 about  Customs,  section 202A letter a, then section 202 letter e, with a maximum threat of 10 years in prison confinement, and a maximum fine of Rp 5 billion.
   
Be sides that it also violates UU No. 17/2008 about Shipping, section 193 verse 1 letter c, Jo 317 UUN No. 17/2008 about Shipping with 1 year maximimum threat and fine  Rp 200 million.
   
The seamans not equipped with seafarer books, its violates section 145 Jo 312, UU No. 17/2008 about Shipping with 2 year criminal penalty and maximum fine Rp 300 million.
   
The crew was not registered as ABK by Syahbandar, thus violating section 135 Jo 310 UU no. 17/2008 on Shipping, maximum threat of 2 years in prison, and a fine of Rp300 million.
   
KLM Putri Setia also does not have a cargo certificate, therefore violates section 117 (2) Jo 302 (10) of UU no. 17/2008 on Shipping with a maximum threat of imprisonment of 3 years, and a fine of Rp400 million.
   
"In this case, we will delegate the legal process to the authorities," said Danlantamal Pontianak.
